This program explores the field aspects of performing a survey pursuant to the new 2016 ALTA/NSPS Standards. All facets of the standards that relate to tasks in the field will be reviewed in order to help field technicians put requirements in context to best meet the needs of the title company, lender and client. This program will address a variety of aspects relating to surveyor ethics and professional conduct in Tex/NM. The speaker has found that every single state experiences most of the same ethical and professional conduct failures on the part of surveyors, so he will share real-life stories/case studies from his 13 years of experience on the Indiana State Board of Professional Surveyors to demonstrate what happened and how the surveyor could have been avoided sanctions, penalties, or worse. This program will instill participants with the many nuances related to easements and rights of way in Texas, including how they differ from licenses and profit, and the types of easements such as affirmative and negative easements, and appurtenant and in-gross. We will explore both how easements can be created and how they can be extinguished or terminated. We will review the many characteristics of easements such as scope, duration, interference, overburdening, and maintenance. This program will also detail the types of unwritten easements and how they are created. Course #1330-001, 4 hours, 4 CEU'S
This program covers the traditional role of the surveyor and provides an argument for how that role could be expanded in order to benefit clients and property owners and to lessen the surveyor’s liability. The cost of litigation has removed it as an option for resolving boundary disputes for millions of homeowners. Surveyors are in the unique position of having a good understanding of boundary law principles and also often being in a place where they can leverage that understanding to the benefit of the public. In this program we will study the genesis of boundary and title disputes, and how surveyors can be part of the solution in helping property owners resolve those problems rather than consigning those owners to the angst and cost of litigation. As part of the program, we will explore the integral relationship between matters of title and matters of survey. Course #1332-001, 4 hours, 4 CEU’s
