The TSPS Governmental Affairs
Committee will meet at 9:00am on Saturday June 4, 2005 to recap the 2005
legislative session.
I think we have had a very good
legislative session for TSPS. The Legislative breakfast, held on March 8
was a great success with good attendance from both the legislative side
and TSPS members. This type of activity goes a long way in maintaining
and furthering our presence and credibility in the legislative process.
Following is a summary of our
results this session and I will have a final update for the Board meeting.
HB854 relating to an
action for damages alleging professional negligence by a registered
professional land surveyor, by Rep. Madden, Senate sponsor Sen. Estes,
previously passed by the House Civil Practices Committee and the Senate
State Affairs Committee, has been placed on the Senate Local & Uncontested
Calendar for May 12, 2005, which is the final step before bill enrollment
(final passage).
HB2179 relating to the
practice of professional surveying, by Rep. Byron Cook, Senate sponsor
Sen. Wentworth, previously passed by the House Licensing & Administrative
Affairs Committee, was passed by the Senate Business & Commerce Committee
on May 10, 2005 and recommended for placement on the Senate Local &
Uncontested Calendar (date to be determined).
HB748 relating to the
application of the sales tax for professional land surveyors, by Rep.
Smith, remains pending in the House Ways & Means Committee.
HB2673 relating to the
creation of an alternative procurement procedure for architectural,
engineering or land surveying services by certain governmental entities,
by Rep. Turner, remains pending in the House Government Reform Committee.
Our success this session was the
result of a lot of work by Mark Hanna and the support I had from George
Sanders and Anne Glasgow. Special thanks to Doug Loveday for all of his
effort in keeping everyone updated thru web site postings and magazine
articles. The result of TSPS membership response, overwhelming I would
say, to the requests for legislative action at certain key times was
extremely instrumental in the success we achieved.

BOARD MEETING DATE: _June 4, 2005__
Received complaint, via
email, of member on March 8, 2005 pertaining to pricing member quoted on
survey for sale of residential property. Investigated and determined no
infraction of ethics had occurred. Responded to complainant that no ethics
violation had occurred and was a business management decision on part of
surveyor in regards to pricing, and in fact we cannot collaborate pricing.
I did not receive a response.

This committee had a meeting in October 2004 during the
convention. The projects to date are still in action and will continue to
be addressed. The committee has submitted a budget request for the year
2005. It is hopeful that the funding for the year 2005 will
get us back on track with the
charges of this committee.
The results of the 2004
Strategic Planning session are as follows:

GOAL:

Seek independent funding to continue
GOAL: Send letters to teachers to include:
Information on e-card
scholarships through TSFI
programs for students like survey
camp, BSA merit badge
survey demographics generated by Gary
Jeffress. (might
want more commentary from Gary to send
along)
GOAL: Seek info re museums with survey display
Work with them to have a live surveyor on site
Create a list for web posting
GOAL: Develop a how-to for community involvement to make
surveying a more visible profession
It is the hope of this
committee that we can get back on track with these matters after the
October 2004 meeting and throughout the year 2005. This committee will be
adding additional members to allow for all of these goals to be met. A
meeting is scheduled for June of 2005 to discuss progress. The committee
has been budgeted $2000.00 for the year 2005.

Strong
Some of the chapters
appear to be working towards our strategic planning goals of having a
TBPLS member present at chapter meetings, holding chapter meetings
targeted at non-survey guests, continuing to add to our list of chapter
meeting topics and getting a chapter education representative involved at
the state level. I have seen some great ideas, with Chapter 11 holding
its 1st Annual Fishing Tournament. They have started having
noon hour meetings with 50 plus in attendance. Other chapters may want to
try this to increase their attendance.
Surpac will be a topic at our Presidents Forum and each chapter should
have it marked high on its priority list. We will continue looking at
creative ways to raise money for this necessary cause.
I look forward to working with our chapter presidents throughout the year
and encourage all chapters to attend all board meetings so they may better
serve their respective chapter. I encourage Chapter Presidents to bring a
new member or guest to the Presidents Forum.
Thank you for the opportunity to work with the chapters this year and I
look forward to continuing with new goals and ideas throughout the year.
As always, I welcome any thoughts or ideas that I may incorporate to help
the chapters to become stronger and more active.
