Title Insurance The Commissioner of Insurance issued a Notice of Hearing for the 2006 Texas Title Biennial Hearings on June 28, 2007. The rulemaking phase of the hearings was held on September 5, 2007. The ratemaking phase will begin at 9:00 a.m. on March 31, 2008. TSPS was admitted as a party on August 20, 2007. To date, no agenda items adverse to the surveying profession have been proposed, with the exception of Agenda Item 2006-64 which imposes certain restrictions upon title agencies owned by producers (e.g., real estate brokers, home builders, and potentially surveyors). Collin County RFI Collin County recently issued RFI No. 07121-07 requesting information from surveyors interested in providing professional services/surveying of various county properties. Section 4.6 of the RFI requires that the Offeror submit copies of completed surveys, comparable projects currently in progress, and other current or future projects including the approximate cost(s) for each. On September 20, 2007, TSPS objected to the RFI as being in violation of the Texas Professional Services Procurement Act and requested that Collin County withdraw RFI No. 07121-07 and revise future RFIs so as to comply with the requirements of the Act. The Collin County Purchasing Agent replied to TSPSs objection via correspondence dated September 27, 2007. To date, it is our understanding that Collin County has not moved forward with its RFI. House Interim Study Charges On November 28, 29, and 30, 2007, Speaker Tom Craddick issued the Texas House of Representatives, 80th Legislature, Interim Study Charges for 2008. Charges of interest include: The Government Reform Committee (chaired by Bill Callegari) will review current laws regarding the licensing of professionals, including streamlining of licensing requirements. The Committee will also review the idea of inspector generals in state agencies and construction defect litigation brought by school districts. The Appropriations Committee will review the current financial condition of TxDOT, including revenues diverted to non-transportation uses and alternative sources of revenue. The Civil Practices Committee will review the filing of meritless litigation and the cumulative effect of tort reform in Texas. The State Affairs Committee will study the use of state funds to advertise governmental programs (i.e., TxDOT). The County Affairs Committee (chaired by Wayne Smith) will look at county procurement statutes. The Environmental Regulations Committee will review the states air permitting process. The Natural Resources Committee will investigate the effectiveness of changes in law related to certificates of convenience and necessity (CCNs), the development of a uniform template for MUDs, and TCEQ fee structures and allocation of resources. The Transportation Committee will study the idea of corridor planning organizations and the role of metropolitan planning organizations. Sunset Review Agencies which will undergo Sunset review during the 2008-2009 biennium include the Texas Department of Transportation, the Texas Residential Construction Commission, and the Texas Department of Insurance. 2008 Elections The filing deadline for candidates seeking Texas Senate and House seats was January 2, 2008. Primary elections will be held on March 4, 2008, and the General Election will be held on November 4, 2008.
